1. General Provisions

These Terms of Use (the "Terms") govern the use of the MY.DRIVE service hosted at mydrive.club (the "Service", "we", "us", "our"), operated by the individual entrepreneur IE MARIIA MORGUNOVA (identification number: 35743997).

MY.DRIVE is an online car rental search service that acts as an aggregator (intermediary) connecting Users with rental companies and car owners (the "Partners").

By using the Service, you confirm that you have read these Terms, agree to them in full, and undertake to comply with them. If you do not agree with these Terms, please do not use the Service.

The processing of your personal data is governed by a separate document — the Privacy Policy, which forms an integral part of these Terms.

2. Status of the Service and the Role of the Aggregator

2.1. MY.DRIVE is not a rental company, lessor, or party to any car rental agreement. The Service provides a technical platform (marketplace) that allows Users to find, compare, and contact Partners for the purpose of renting vehicles.

2.2. The car rental agreement is concluded directly between the User and the Partner. All rental terms — price, deposit, cancellation conditions, insurance, condition of the vehicle, and the procedure for handover and return — are determined by the Partner and governed by the agreement between the User and the Partner.

2.3. MY.DRIVE does not carry out or take part in the receipt or processing of rental payments. Payment is made directly between the User and the Partner or through payment means provided by the Partner.

2.4. We make reasonable efforts to verify the accuracy of the information posted by Partners (vehicle descriptions, prices, photographs, terms); however, we do not guarantee its complete accuracy, currency, or completeness, as this information is provided by the Partners themselves.

3. Who May Use the Service

3.1. The Service is intended for persons over 18 years of age who have full legal capacity and a valid driver's license.

3.2. By using the Service, you warrant that you provide truthful, accurate, and up-to-date information about yourself.

3.3. When registering an account, you are responsible for keeping your login credentials confidential and for all actions taken using your account.

4. Rules for Using the Service

When using the Service, you undertake not to:

  • provide knowingly false, misleading, or incomplete information (including when making a booking);
  • create fictitious booking requests or bookings that you do not intend to honor;
  • use automated means (bots, scrapers, parsers) to collect data from the Service without our written consent;
  • disrupt the operation of the Service or attempt to gain unauthorized access to its infrastructure or to other users' data;
  • use the Service for unlawful purposes or for purposes that infringe the rights of third parties;
  • copy, reproduce, or distribute the Service's content without permission (see Section 6).

We reserve the right to suspend or terminate a User's access to the Service in the event of a breach of these Terms, including repeated unjustified cancellations of bookings or no-shows.

5. Bookings

5.1. By submitting a booking request through the Service, the User sends the Partner a request to rent a vehicle on the specified terms. Confirmation of the booking is carried out by the Partner.

5.2. Booking cancellation conditions, no-show penalties, and the procedure for changing dates are determined by the Partner and are set out on the booking page or agreed directly with the Partner.

5.3. MY.DRIVE is entitled to cancel or void a booking request if signs of fraud or a breach of these Terms are detected, or at the request of the Partner.

6. Intellectual Property

6.1. All content of the Service — texts, design, logo, site structure, photographs (except for materials posted by Partners and belonging to them), and databases — is the intellectual property of MY.DRIVE or is used on lawful grounds.

6.2. The use, copying, reproduction, or distribution of the Service's content without prior written consent is prohibited, except in cases expressly permitted by law.

7. Limitation of Liability

7.1. The Service is provided "as is". We do not guarantee the uninterrupted or error-free operation of the Service or the availability of specific vehicles at the time of booking.

7.2. MY.DRIVE is not liable for:

  • the actions, omissions, quality of services, technical condition of vehicles, or good faith of the Partners;
  • any damage, losses, or disputes arising under the rental agreement between the User and the Partner;
  • the content, accuracy, or currency of information posted by Partners;
  • technical failures, unavailability of the Service, or errors in the display of prices or data caused by circumstances beyond our reasonable control.

7.3. To the maximum extent permitted by law, the aggregate liability of MY.DRIVE to the User on any grounds related to the use of the Service is limited to direct, documented damage and does not include indirect, incidental, or lost profits.

7.4. Nothing in this Section limits liability in cases where such limitation is not permitted by applicable law.

8. Disputes Between the User and the Partner

Any disputes, claims, or disagreements arising out of a car rental agreement are resolved directly between the User and the Partner. MY.DRIVE may, at its discretion, assist in resolving a dispute (for example, through customer support), but is not a party to such dispute and is not liable for its outcome.

9. Changes to the Terms

We may amend these Terms at any time. The current version is always published on the site with the date of the last update. We may additionally notify you of material changes through the Service or by email. Continued use of the Service after changes are made constitutes your acceptance of the updated Terms.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of Georgia. Any disputes not resolved through negotiation are subject to the jurisdiction of the competent courts of Georgia, unless otherwise mandatorily provided by applicable consumer protection legislation of the User's place of residence (for EU users).
